The client was a highschool honor roll student that decided to celebrate Fourth of July with friends in Daytona Beach, Florida. A Daytona Beach Police officer noticed our client standing near a picinic table with a number of beer bottles left on it. He ordered her to sit down at the table. Before she could explain that she was not with the group of people that was eating at the table earlier, the officer cited her for open container. The client's friends were also charged for possession. Instead of fighting the charge the client's co-defendants entered into intervention programs. After discussions with the state attorney the officer was contacted. Eventually, the officer agreed he may have cited her before finding out whether she was actually in possession of the beer.
